If either
the Claimant or Respondent wishes to appeal the decision of a Dispute
Committee of a Regional Joint Industry Board they must send to the Secretary
of the JIB, within twenty eight days of the receipt of the written confirmation
of the Dispute Committee's decision, their Notice of Appeal and a statement
setting out the reasons why they consider the Dispute Committee was in
error in coming to its decision.
The Notice and statement is referred to the National Appeals Committee
for preliminary
consideration and it is within the Committee's absolute discretion whether
or not a case has been made to justify leave being granted for the appeal
to be heard.
Although there is no provision for further appeals under the Disputes
Procedure employer and
employee participants do have the right under the Rules of the JIB to
complain to the Chairman of the JIB if they feel they have been unfairly
treated.
The JIB was unique in that it was granted the country's only exempted
Dismissal Procedures
Agreement in 1979 which was granted by the Secretary of State. It meant
that certain Unfair Dismissal cases had to be heard by the JIB and not
by an Industrial Tribunal. However this is no longer in force due to the
implications of the Human Rights Act 1998. Nevertheless the ECA and Unite
(Amicus section) have given their committal to trying to ensure that the
JIB deals with Unfair Dismissals as part of the Industry's procedure prior
to pursuing a claim at the Employment Tribunal. Full details are available

Since 1985, the number of Dispute Committees has reduced as a result of
the conciliated settlements achieved by the National Officers of the JIB.

Since 2004, the final stage of appeal is with the JIB Chairman for any
Operative without the requisite service for an Employment Tribunal. Operatives
who can pursue a claim at the Employment Tribunal only have one hearing
within the JIB's procedures.
